1. Eligibility & accounts
You must be at least 18 years old and using the Service for a business. The person who signs up (the “Owner”) is responsible for the account, for the people they invite, and for keeping login credentials secure. You agree to provide accurate information and to keep it current. You are responsible for all activity under your account.
2. The Service
AECO provides tools for crew scheduling, a time clock (including optional GPS auto clock-in and geofence checks), timesheets, job tracking, receipts, and payroll support. We may add, change, or remove features. We aim for high availability but do not guarantee the Service will be uninterrupted or error-free.
3. Free trial, fees & auto-renewal
- Free trial. New companies may start with a free trial. We may change or end trial offers at any time.
- Subscription fees. Paid plans are billed in advance through Stripe at the price and interval shown at checkout. Fees are stated exclusive of taxes, which you are responsible for.
- Automatic renewal. Your subscription automatically renews for successive periods at the then-current price, and your payment method is charged at the start of each period, until you cancel. You consent to this recurring charge when you subscribe. This disclosure is provided consistent with California’s automatic-renewal law (Bus. & Prof. Code § 17600 et seq.).
- How to cancel. You can cancel at any time from your billing settings or through the Stripe billing portal. Cancellation stops the next renewal; it takes effect at the end of the current paid period.
- Usage extras. Each seat includes a monthly number of AI receipt reads. If your company uses more, or adds storage packs, those extras are charged only at the prices shown on your billing page before you choose them; nothing is added to your bill that you did not turn on.
- Refunds. Except where required by law, fees already paid are non-refundable.
- Price changes. We may change prices; we will give notice before a change applies to your next renewal.
4. Your data & your responsibilities
As between you and AECO, the data you and your crew put into the Service is yours. You grant us the limited rights needed to host and process it to provide the Service. For personal information about your workers, you are the controller/business and AECO is your service provider, as described in our Privacy Policy, which is incorporated into these Terms.
You are responsible for your own legal compliance as an employer, including:
- Having a lawful basis to collect your workers’ information, including precise geolocation, and giving them any notices and obtaining any consents the law requires.
- Your own wage-and-hour, overtime, meal-and-rest-break, and record-keeping obligations. AECO’s overtime and meal-period features are informational tools, not legal, tax, or payroll advice; you are responsible for reviewing results and paying your workers correctly.
- The accuracy of the data you enter and the decisions you make using the Service.
4.1 Service-provider terms (data processing)
For personal information you or your workers put into the Service, AECO acts as your service provider (or processor) and agrees that it will:
- process that information only to provide, secure, support, and improve the Service for you, and for no other business purpose, and never for cross-context behavioral advertising;
- not sell it, not share it for cross-context behavioral advertising, and not retain, use, or disclose it outside the direct business relationship between you and AECO or for any purpose other than the ones above;
- not combine it with personal information received from another customer or collected from its own interaction with a consumer, except as permitted for a service provider by law;
- comply with the California Consumer Privacy Act and other applicable privacy laws and provide the same level of privacy protection they require of you, and notify you promptly if it determines it can no longer meet those obligations;
- help you respond to requests from your workers to access, correct, delete, or obtain their information, including through the download and erase tools built into the Service;
- engage subcontractors (the providers listed in our Privacy Policy) only under written terms at least as protective as these, and remain responsible for them;
- allow you to take reasonable and appropriate steps to confirm that AECO uses the information consistently with your obligations, including answering reasonable written questions about our practices, and to stop and remediate any unauthorized use; and
- delete or return the information when you close your company or erase a worker, except for records we must keep by law (hours and payroll records are retained without a name).
5. Acceptable use
You agree not to: break the law or infringe others’ rights; access another company’s data or attempt to defeat the Service’s security or tenant isolation; probe, scan, or load-test the Service without our written permission; upload malware; reverse engineer or copy the Service except as the law allows; resell or provide the Service to third parties without our permission; or use the Service to track people who are not your workers acting within the scope of their work.
6. Your content & copyright (DMCA)
You are responsible for the photos, notes, forms, and other content uploaded to your account, and you confirm you have the right to upload it. We respect copyright and respond to valid notices under the Digital Millennium Copyright Act (DMCA), and we may remove content and terminate repeat infringers. Send copyright notices to info@albrikelectric.com with the subject “DMCA Notice,” including the information 17 U.S.C. § 512(c)(3) requires (the work, the material and where it is, your contact details, your good-faith and accuracy statements, and your signature). When our agent registration with the U.S. Copyright Office is filed, the agent’s name and mailing address will be listed here and in the Copyright Office directory.
7. Our intellectual property
The Service, including its software, design, and trademarks, is owned by Albrik Electric Co. and its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription, subject to these Terms. We keep all rights not expressly granted.
8. Third-party integrations
If you connect a third-party service (for example Stripe, Gusto, QuickBooks, Google, or Microsoft), your use of it is governed by that provider’s own terms and privacy policy. We are not responsible for third-party services, and connecting them authorizes AECO to exchange the data needed for the integration.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be error-free or uninterrupted, or that any compliance feature meets your legal obligations. You are responsible for verifying results before relying on them.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, AECO AND ALBRIK ELECTRIC CO. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow these limits, so parts of this section may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless AECO and Albrik Electric Co. from claims, losses, and expenses (including reasonable legal fees) arising out of your data, your use of the Service, your violation of these Terms, or your violation of law or the rights of others — including any claim by your workers relating to information you chose to collect through the Service.
12. Term & termination
These Terms apply while you use the Service. You may stop and cancel at any time. We may suspend or terminate access if you violate these Terms, fail to pay, or to protect the Service. When your subscription ends you can export your data for a reasonable period, after which we may delete it. You can also close your company at any time, which cancels billing and deletes your data and files. Sections that by their nature should survive (such as fees owed, disclaimers, limitation of liability, and indemnification) will survive.
13. Governing law & disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The parties agree to resolve disputes through binding individual arbitration and waive the right to a jury trial and to participate in a class action, except for small-claims matters and claims for injunctive relief; otherwise, the state and federal courts located in Los Angeles County, California will have exclusive jurisdiction and venue.
14. Changes to these Terms
We may update these Terms. We will change the “Last updated” date and, for material changes, give more prominent notice. Continued use after an update means you accept the revised Terms.
15. General
These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any part is unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale. Neither party is liable for delays caused by events beyond its reasonable control. Notices to you may be sent through the Service or to the email on your account.
